Terms and Conditions - Video Message Service

These Terms and Conditions describe the contractual and legal relationship between a user of the Livstick service ("You") and Livstick S.A.S., the company that created and operates the service ("Livstick" or "We"). Livstick S.A.S. is a French SAS, headquartered at 13 Bis avenue de la Motte-Picquet, 75007 PARIS.

1. Definitions

• LIVSTICK: A service enabling the buyer of a gift to add a private and personal message for the person who will receive the gift.
• MESSAGE: video, picture, or voice message, enriched with a text message.
• HOST: A company that offers the LIVSTICK service.
• SENDER: The party recording a message.
• RECEIVER: The party who will view the message.
• CODE: unique code to access the service (QR Code or hyperlink).

2. How to use Livstick

For SENDERS, LIVSTICK will be accessible via a hyperlink provided by the HOST or via a QR CODE printed on a card.

For RECEIVERS, the MESSAGE will be accessible via an email or by scanning a QR Code.

3. Use of the Website

The WEBSITE allows the SENDER to link a MESSAGE to a Livstick CODE.

The SENDER and RECEIVER agree to provide LIVSTICK with legitimate and truthful information.

4. Data Privacy

Your personal data may be used to allow you to modify your message, notify you when your message is first viewed, and contact you when needed.

5. User's Rights

In compliance with GDPR (EU) 2016/679, you have rights of access, rectification, erasure, restriction, objection and portability.

6. Intellectual Property

MESSAGES linked to LIVSTICK CODES remain your ownership.

7. Limitation of Liability

THE LIVSTICK SERVICE AND LIVSTICK CONTENT ARE PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND.

8. Financial Conditions

The LIVSTICK service is offered by the HOST. Unless specified otherwise, the service is free of charge for the SENDER and the RECEIVER.

9. Termination

If you violate these Terms, we reserve the right to delete your MESSAGE.

11. Dispute Resolution
